Terms of Service

Welcome to Perfumious. These Terms of Service (“Terms”) govern your use of perfumious.com (the “Site”) and your purchase of products from it. The Site is operated by Aurelivio LLC, a company doing business as Perfumious (“Perfumious,” “we,” “us,” “our”).
By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old (or the age of majority in your state) to make a purchase. By ordering, you confirm that you meet this requirement and that all information you provide is accurate.
2. Products and Authenticity
All fragrances sold on the Site are 100% authentic, brand-name products sourced from established US wholesale distributors. Perfumious is an independent retailer and is not affiliated with, endorsed by, or sponsored by the fragrance brands or manufacturers whose products we sell. All brand names, trademarks, and product images are the property of their respective owners and are used solely to identify the genuine products offered for sale.
Product packaging may vary (e.g., tester packaging where clearly indicated in the product description). Colors and packaging shown in images may differ slightly from the item delivered due to manufacturer updates.
3. Pricing and Product Information
All prices are in US dollars. We work to keep product information and pricing accurate, but errors can occur. If a product is listed at an incorrect price or with incorrect information, we may cancel the affected order and issue a full refund, and will notify you promptly. We may change prices, products, and promotions at any time without notice.
4. Orders and Acceptance
Your order is an offer to purchase. An order is accepted only when we send you a shipping confirmation. We may refuse or cancel any order at our discretion – including for suspected fraud, pricing errors, product unavailability, or address issues – with a full refund of any amount charged.
If an item becomes unavailable after you order, we will contact you with the option of a substitute, backorder, or full refund.
5. Payment
Payments are processed securely by Stripe. We accept the payment methods displayed at checkout. Your card is charged when you place your order. You represent that you are authorized to use the payment method provided. We do not store full card numbers on our servers.
To protect against fraud, we may request additional verification before shipping and may cancel orders that fail verification.
6. Shipping and Delivery
We currently ship to addresses in the United States. Shipping costs and estimated delivery times are shown at checkout, which is part of these Terms. Delivery estimates are good-faith estimates, not guarantees.
Risk of loss and title pass to you upon our delivery of the package to the carrier. If your tracking shows delivered but you did not receive the package, contact us within 7 days at info@perfumious.com and we will work with the carrier to resolve it.
7. Returns and Refunds
Returns and refunds are governed by our Returns & Refunds Policy, which is part of these Terms. In summary: unopened, unused items in original sealed packaging may be returned within the period stated in the policy; opened fragrances cannot be restocked and are eligible only if the item arrived damaged, defective, or incorrect – in which case we make it right at no cost to you.

8. Chargebacks
If you have any problem with an order, contact us first – we resolve virtually all issues faster than a card dispute. Chargebacks filed on orders that were delivered as described, with proof of delivery, may be contested with the relevant evidence.
9. Your Account and Conduct
If you create an account, keep your credentials confidential – you are responsible for activity under your account. You agree not to use the Site for any unlawful purpose, to place fraudulent orders, to interfere with the Site’s operation, to scrape or copy its content at scale, or to attempt unauthorized access to any systems.
10. Intellectual Property
The Site’s original content — including text, layout, design, logo, and product descriptions written by us – is owned by Aurelivio LLC and protected by applicable intellectual property laws. You may not republish, resell, or reproduce Site content without our written permission. Third-party trademarks remain the property of their respective owners (see Section 2).
11. Reviews and User Content
If you submit reviews or other content, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with the Site and our marketing. You represent your content is your own, accurate as to your experience, and not unlawful, defamatory, or infringing. We may remove user content at our discretion.
12. Communications
By opting in to email or SMS marketing you consent to receive recurring messages; consent is not a condition of purchase, message/data rates may apply, and you can opt out at any time (unsubscribe link, or reply STOP to SMS). Transactional messages (order and shipping confirmations) are sent as part of fulfilling your order.
13. Disclaimer of Warranties
The Site is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, regarding the Site itself. This does not affect any non-waivable statutory rights you have as a consumer, or manufacturer warranties that may accompany products.
Allergy note: fragrance products contain ingredients that may cause allergic reactions in some individuals. Review the manufacturer’s ingredient information and discontinue use if irritation occurs.
14. Limitation of Liability
To the maximum extent permitted by law, Aurelivio LLC’s total liability for any claim arising out of these Terms or your use of the Site is limited to the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Aurelivio LLC and its members, officers, and agents from claims arising out of your violation of these Terms or misuse of the Site.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles. Before filing any claim, you agree to contact us at info@perfumious.com and attempt to resolve the dispute informally for 30 days. Any dispute not resolved informally shall be brought in the state or federal courts located in Wyoming, unless applicable consumer law grants you the right to bring the claim in your local courts.
17. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of it. We are not liable for delays or failures caused by events beyond our reasonable control (carrier disruptions, natural disasters, etc.). These Terms, together with the Privacy Policy, Shipping Policy, and Returns & Refunds Policy, are the entire agreement between you and us regarding the Site.
18. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date and applies to orders placed after posting.
